PrivatBank and deposits - how a client almost lost 100 thousand dollars.


The state-owned PrivatBank did not pay the client deposits totaling 122,051 dollars. Notably, the woman sent a request to terminate the agreements to the bank back in 2021.
This is stated in the decision of the Pechersk District Court of Kyiv.

As mentioned in the case materials, the client and PrivatBank concluded three 'Standard' deposit agreements in June and September 2013. However, in March 2014, the Ukrainian lost access to her deposits, and PrivatBank suspended the accrual and payment of interest on the deposit agreements. In the fall of 2021, the woman sent a letter to the bank demanding the following:
- to terminate the agreements two working days after receiving the letter;
- to return the deposits and accrued interest.
When PrivatBank did not respond to the woman's request, she decided to go to court and warned the financial institution about it.
What the court decided
The court found the Ukrainian's claim lawful and satisfied her demand for the recovery of funds from the deposit accounts opened at PrivatBank. According to the court's decision, the financial institution will return the claimant:
- the deposit under the 'Standard' agreement in the amount of 44,281 dollars and interest on the deposit agreement in the amount of 27,770 dollars;
- the funds from the deposit under the 'Standard' agreement in the amount of 50 thousand dollars and interest on the deposit agreement amounting to 24,758 dollars;
- 11.5 thousand dollars from the deposit plus interest on the deposit agreement amounting to 5.3 thousand dollars.
'AT KB 'PrivatBank' did not fulfill its obligations. The existence of contractual obligations and the fact of the plaintiff's contribution of funds are confirmed by the evidence provided to the court, namely the contract and bank receipts, the originals of which were examined by the court. The defendant's party did not provide proper and admissible evidence to refute the claims made, nor were its own calculations regarding the accrued debt and interest for the use of funds presented,'- states the court's decision.

After many years of litigation, the woman signed deposit agreements with PrivatBank, but at the end of the journey, the court recognized her rightness and decided to recover the amount of deposits along with interest from the bank.
